TERMS AND CONDITIONS OF CARRIAGE |
“Airline” means Polynesian Ltd doing business as Samoa Airways;
“Airline Designator Code” means the two or three letter or number code issued by IATA to each airline to identify that airline and its flights;
“Authorised Agent” means an agent who is authorised by Samoa Airways to represent and sell Samoa Airways passenger services;
“Baggage” means your personal property accompanying you on your trip. It consists of both your checked baggage and cabin baggage.
“Baggage Allowance” means the allowance for your baggage, as set out in the Fare Rules and administered in accordance with section 12 & 13 of these Conditions and the Policies;
“Baggage Fee” means any fee specified in the Fare Rules as payable by you for us to carry Checked Baggage;
“Booking” means the booking request made by you or on your behalf, and accepted for travel on a Samoa Airways flight, the Itinerary, the boarding pass, the Ticket, the baggage check, and/or any other document or message from us relating to the contract for carriage concerning your travel;
“Carrier” means all air carriers that carry or undertake to carry you and your baggage or perform any other service.
“Carry-on Baggage” means baggage, personal effects or other articles (not being Checked Baggage) which accompanies you in the aircraft cabin during the provision of transport and services the subject of the Booking;
“Checked Baggage” means baggage, personal effects or other articles registered with us as baggage intended to be carried in the aircraft hold during the provision of transport and services the subject of the Booking and for which a bag tag number is issued by us;
“Codeshare Partner” means an airline with whom Samoa Airways has an agreement to operate Codeshare Services;
“Codeshare Service” means a service which has a “OL” flight number but is operated by another operating carrier;
“Conditions” means these Conditions of Carriage;
“Contract” means your acknowledgement and acceptance of –
- this ticket and its terms; our General Conditions of Carriage (Passenger and Baggage) and any applicable tariffs filed with governments;
- applicable laws and international conventions;
- the fare rules as applicable; and
- any oral or written directions issued by the Airline.
To which the carriage of all passengers on any flights under the OL Code is subject.
“Convention” means (as applicable): the Convention for the Unification of Certain Rules Relating to International Carriage by Air (1929) (“Warsaw Convention”); the Warsaw Convention as amended at The Hague (1955); the Warsaw Convention as amended by Additional Protocol No. 1 of Montreal (1975); the Warsaw Convention as amended at The Hague and by Additional Protocol No. 2 of Montreal (1975); the Warsaw Convention as amended at The Hague and by Additional Protocol No. 4 of Montreal (1975); the Guadalajara Convention (1961); and the Montreal Convention (1999) (“Montreal Convention”);
“Destination” means the last destination shown on your Itinerary. When not capitalised, destination refers to a generic point of arrival;
“Fare” means the applicable fare set by Samoa Airways for travel contemplated in a Booking (at the time of payment for the Booking), along with applicable fees and surcharges, and any taxes imposed by governments on the travel to which the Booking relates;
“Fare Rules” means those additional terms and conditions attaching to the transport and services the subject of the Booking (of which you are notified at the time of booking and which are available at www.samoaairways.com);
“Flight Coupon” means that portion of the Ticket that bears the notation “good for passage,” or in the case of an Electronic Ticket, the Electronic Coupon, and indicates the particular places between which you are entitled to be carried;
“Samoa Airways” means Polynesian Limited trading as Samoa Airways;
“OL Code” means the code issued to the Airline by the International Aviation Transport Authority (IATA) for purposes of its identification as well as its destination and its traffic documents;
“IATA” means the International Air Transport Association;
“International Travel” means international carriage as defined in the Convention;
“Itinerary” means the document Samoa Airways or an agent provides to you which details your flights;
“Laws” means the laws of any nation which apply to your travel with Samoa Airways;
“Loss” means any loss, damage, cost or expense, including consequential or indirect loss, loss of savings, business opportunities, revenue, profit and/or damage to goodwill;
“Medical Clearance Form” means the form we require you to complete if you fall within any of the applicable categories of persons set out in the Samoa Airways Medical Clearance Guidelines;
“Medical Clearance Guidelines” means the guidelines which apply to Guests travelling on Samoa Airways flights who have an illness or a medical condition and which are published on our Website;
“Montreal Convention” means the Montreal Convention 1999.
“Paper Ticket” means a Ticket printed on authorised ticketing paper, and includes Flight Coupons;
“Piece Limit” means the piece limit for your Checked Baggage, which is determined by your fare type and is specified in the Fare Rules;
“Ticket” means a document which validly entitles you travel on flights operated or marketed by Samoa Airways, being either an Electronic Ticket or a Paper Ticket;
“Ticketing Time Limit” means the time limit set by Samoa Airways within which you must pay the Fare for a Booking;
“Warsaw Convention” means the Warsaw Convention 1929, or that Convention as amended at the Hague on 28 September 1955 and by Montreal Protocols [Nos. 1, 2 and 4] whichever may be applicable;
“Weight Limit” means the weight limit for Checked Baggage determined by the type of fare purchased by you when making a Booking. The weight limit and the terms and conditions that apply for receiving the benefit of the weight limit are specified in the Fare Rules and on our Website.
2. CONDITIONS OF CONTRACT |
2.1 Carriage hereunder is subject to the provisions of the Warsaw Convention or Montreal Convention as
applicable unless such carriage is not “international” carriage as defined by those conventions.
2.2 To the extent not in conflict with the Conventions, your carriage and other services performed by the Airline are subject to:
- Conditions endorsed on the Itinerary & receipt / Boarding pass / E-ticket wallet;
- These Terms and Conditions of Carriage (Passenger and Baggage), and any applicable tariffs filed by Samoa Airways with regulatory bodies;
- Applicable laws and International Conventions;
- The Airline’s oral and/or written directions to passengers;
- In the event of any inconsistency between these Terms and Conditions and any General Conditions of Carriage, the General Conditions of Carriage shall prevail.
2.3 If Samoa Airways issues a ticket or boarding pass for another carrier’s flight, it does so only as an agent for that carrier.
2.4 Unless otherwise stated, a ticket is valid for one year from the issue date.
2.5 Samoa Airways will use all efforts to carry you and your baggage reasonably in accordance with the date and time of the flight(s) specified but does not guarantee it will be able to do so. Schedules may change without notice due to adverse weather conditions or other factors.
2.6 You must:
- Comply with all applicable government travel requirements including the carriage of valid passports and visas to enter the countries to which you are travelling; and
- Please ensure check in by the required check-in time.
2.7 The contract between you and the Airline, including any exclusion or limitation of liability, applies to benefit:
- Samoa Airways employees, agents and representatives;
- All other carriers used by Samoa Airways to carry you; and
- Those other carriers’ employees, agents and representatives, and Samoa Airways holds that benefit on trust for them, and can, if requested by them, enforce it on their behalf.
2.8 If your checked baggage on Samoa Airways international flight has been lost or damaged (or part thereof), you must notify the Airline in writing within 7 days and in the case of delay, within 21 days of delivery. In respect of damage, loss or destruction of cabin baggage you must notify the Airline in writing within 7 days from the date the carriage ended. If your checked baggage is lost or destroyed during domestic carriage you must notify the Airline in writing within 21 days from when you should have received the checked baggage. In respect of damage, loss or destruction of cabin baggage, you must notify the Airline in writing within 7 days from the date when the carriage ended.
2.9 The e-ticket document does not constitute a document of carriage and in the event of any differences between it and the record of booking in Samoa Airways databases, the latter will prevail.
3. OPERATION OF CONDITIONS |
3.1 These Conditions will apply to your travel on flights operated or marketed by us (flights operated under the “OL” Airline Designator Code), to the extent they are applicable to your journey.
3.2 These Conditions do not apply to any non-air transportation or other services arranged by a third party (for example, bus transfers or hotel accommodation).
3.3 A Booking is valid only for provision of the transport and services in respect of which it is accepted by Samoa Airways. Booking changes may be made dependent on the Fare purchased. If you fail to travel on the scheduled services or the fare lapses, the ticket may no longer be valid for travel on Samoa Airways services.
4.1 Samoa Airways will notify you of use of Codeshare Services on the passenger itinerary or website.
4.2 Codeshare Services are operated by airlines in which a codeshare agreement has been entered into by Samoa Airways. Some codeshare airlines may provide services via a different aircraft type with different products offerings (i.e. fees, baggage and inflight product) which are available on our aircraft but not by the codeshare airline. Passengers are to refer to the codeshare airlines website for further information prior to booking.
5. INTERLINE SERVICES / OTHER CARRIERS |
5.1 At times you may travel on services which we sell but which are operated by other carriers under those carriers’ flight numbers and Airline Designator Codes. If we issue you an Itinerary or a Ticket for carriage on another carrier’s flight and Airline Designator Code, we do so only as an agent for that carrier, and that carrier’s conditions of carriage will apply. The operator’s conditions of carriage may significantly limit or exclude liability. You should refer to the operating carrier’s website for further information.
Samoa Airways have various fare rules that apply to fares offered by the airline. The Samoa Airways website defines the fare rules and provides information on the flexibility and pricing arrangements for the fare.

7. INTERNATIONAL TRAVEL - PASSENGER VISAS AND PASSPORTS |
It is the passenger’s responsibility to comply with all Laws, regulations and orders of the destination that you are travelling to. Each country has different requirements and obligations for you as the passenger, and you should consult with the government which issued your passport, and consider the following:
- You must have a valid passport. If your passport expires in 12 months or less, you should check whether this is sufficient for travel to Samoa, or other forward destination;
- Check with the government which issued your passport, and the consulates of your chosen destinations, to see whether you need a visa or other travel document, or other information such as vaccination records;
The items set out above are given as a guide only. It is your responsibility to ensure that you have all required authorisations and documentation for your travel. Any assistance which we may provide you in this area does not release you from your obligation.
8. GUESTS WHO REQUIRE SPECIAL ASSISTANCE |
8.1 Special Assistance
If you require special assistance (for example, due to illness, incapacitation, limited mobility, or travelling as an unaccompanied minor) beyond that which we are required to provide by applicable Law, we will carry you provided that:
- you have fully informed us of any special requirements at the time of making a Booking;
- you have complied with any reasonable requests we may have (including complying with our Policies); and
- Samoa Airways (and the operator of any relevant Codeshare Services) have agreed to provide the special assistance.
For flights between Samoa and American Samoa, check-in opens 2 hours prior to the scheduled departure times and closes 30mins prior to scheduled departure times.
You must check in for travel at least 2 hours prior to the scheduled departure time or as otherwise set out in your Itinerary for these services.
You must check in to board the flight at our check-in facility serving the place of departure. You will be advised of the check-in time for your flights in your Itinerary and/or by your Authorized Agent. However, flight times may change, and different airports may have different check-in deadlines, so you must also make sure you are aware of the check-in deadline for all of the flights shown on your Ticket.
Subject to the Fare Rules applicable to your Booking, if you fail to arrive at the airport and/or check in by the time specified, the fare and any baggage fee paid for that flight will be forfeited and seats cancelled or re-allocated.
You must arrive at the airport early enough to allow you to complete check-in procedures before the check-in deadline and you must bring with you a valid passport, your Paper Ticket, E-Ticket (if issued electronically) and all necessary travel documentation for travel to your final destination country, including all relevant travel documents for all transit countries.
If travelling in large groups or require additional assistance, we recommend that you check-in 2 hours prior to the scheduled departure times of your flights. If you have a Special Service Request, please ensure this is requested through your booking channel at least 72 hours prior to the scheduled departure times of your flights.
9.1 All Travel
You must bring with you all travel documentation necessary for us to accept you on your flight, including a valid passport or other valid identification, and all necessary travel documentation for your Destination. You must present all of these documents to our staff at the airport if you are asked to do so.
You must keep any material we give you at check-in (such as a boarding pass and a baggage check document) until you complete your travel with us and you must permit us to make copies of them for security and procedural requirements, and as required by any Laws.
Arriving at the boarding gate. You must complete all departure formalities (such as clearing Immigration) in time to arrive at the boarding gate no later than the time specified to you at check-in and displayed on the flight information displays at the airport.
If you are late or you do not comply with the check-in procedures set out in these Conditions, we reserve the right to cancel your Booking, refuse to carry you, and to charge you a reasonable service fee, subject to the Fare Rules applicable to your Booking.
10. SCHEDULE CHANGES AND DISRUPTIONS |
10.1 Samoa Airways will use all reasonable endeavours to provide to you the mode of transport or services the subject of the Booking but, in circumstances beyond our control, we may without notice substitute other means of transport or service. Samoa Airways will not be liable for any Loss you may incur as a result of any such substitution.
10.2 If you are landed at a destination other than that specified in the Booking, Samoa Airways will make all reasonable endeavours to take you to the specified destination but we do not have any obligation to you in relation to the time this will take nor the means of transport that will be used.
10.3 When you make a Booking, Samoa Airways or an Authorised Agent will tell you the scheduled time of your flights. These times will also be noted on your Itinerary and may be noted on your Ticket. If we change the time of your flight, we will make reasonable attempts to contact you or your Authorised Agent, using the contact details you have provided us. We do not guarantee that we will contact you, and so you should check prior to your flight to make sure your flight times have not changed.
10.4 Samoa Airways will try to ensure that you and your Baggage depart and arrive as close as possible to the scheduled times. However, we do not guarantee flight times or schedules, and they do not form part of your contract of carriage.
10.5 Samoa Airways may need to cancel or delay and reschedule flights or services due to industrial action, landing restrictions, airport loading restrictions, unsuitable weather conditions, technical problems, operational reasons, or any event beyond our reasonable control, and scheduled flight times or destinations are not guaranteed. We are not liable for any Loss which you may incur as a result of any such delayed or rescheduled flight or service.
11.1 Samoa Airways may offer two or more flight sectors for sale as a scheduled connection (“Connecting Flight”). In the event that a Connecting Flight fails to connect, we will use reasonable measures to enable you to travel on our next available flight to the destination at which you were due to arrive on the Connecting Flight. However, we do not provide any guarantee whatsoever that any two or more single sector flights (which are not offered for sale as Connecting Flights) will connect (even though you may book such single sector flights with the intention of those flights connecting).
11.2 Subject to these Conditions, Samoa Airways are not liable for or in connection with any Loss which you may incur as a result of any such single sector Booked flights failing to connect.
11.3 Other than for Connecting Flights, Samoa Airways do not offer, provide or guarantee connections between the flights we offer and the flights of another carrier or any other form of transport, and subject to the provisions of these Conditions, we are not liable for or in connection with any Loss which you may incur as a result of any such flight failing to connect with the flight of another carrier or another form of transport.
12. CABIN BAGGAGE ALLOWANCES |
12.1 Passengers (except infants) are allowed the following baggage allowances:

12.2 Enhanced security screening measures apply on international flights from and to Samoa with respect to the carriage of liquids, aerosols and gels. If you want to take liquids, aerosols or gels through the screening point, make sure each item is 100ml or less and all items fit comfortably in a transparent re-sealable 1 litre plastic bag. Only one bag per person is allowed.
12.3 Restrictions on Cabin Baggage
Some items cannot be carried in the cabin of the aircraft and are therefore classified as Prohibited Items under this Conditions of Carriage. Prohibited Items include but are not limited to weapons, restraining devices, knives and sharp tools or cutting implements such as scissors and screwdrivers, lighters and some sporting goods such as bats and clubs. The list of Prohibited Items may vary depending where you board an aircraft. Samoa Airways have the right to amend the list of Prohibited Items from time to time. Please check with us or your Authorized Agent prior to travel on what items you may be permitted to take in as Checked Baggage.
It’s important to know that even if an item is generally permitted, it may be subject to additional screening or not allowed through the checkpoint if it triggers an alarm during the screening process, appears to have been tampered with, or poses other security concerns. The final decision rests with the air transport security authority on whether to allow any items on the plane. Also, please note that some of these Prohibited Items are illegal in certain jurisdictions and passengers will be subject to the law of that jurisdiction. It is a passenger’s responsibility to be aware that origination and destination ports may have local laws prohibiting the possession of these items. If you try to include a Prohibited Item in your Cabin Baggage, you acknowledge that we have the right to take them from you. We do not accept any responsibility for items which we refuse to carry as Cabin Baggage and which are not carried as Checked Baggage. You are responsible for your personal items that are in your care and control.
12.4 Cabin Baggage Non-Compliant Fees
Non-compliant cabin bags are subject to excess charges at the check-in counter when checked in and the following cabin bag fees are applicable for any non-compliant cabin bags found at the boarding. This is charged from OL’s point to point routes.
13. CHECKED BAGGAGE ALLOWANCES |

13.2 Checked Baggage Policy
- Checked Baggage will, whenever possible, be carried on the same aircraft as you, unless Samoa Airways decide for safety, security or operational reasons to carry it on an alternative flight. If your Checked Baggage is carried on a subsequent flight we will deliver it to you unless applicable law requires you to be present at the airport of arrival for customs clearance.
- Unacceptable Items as Checked Baggage
While Samoa Airways will make best efforts to take care of your checked in items, we cannot guarantee that delicate or valuable items are able to withstand baggage handling processes during carriage by air. Checked Baggage can also be delayed, damaged or lost, therefore items which you may consider valuable to you or which you may need urgently should be carried with you as unchecked baggage provided it is not classified as one of the Prohibited Items listed in 14 (a) below and or by any applicable laws and regulations.
The following items must NOT be included in your Checked Baggage. You will be required to remove such items from your checked baggage and either carry them as unchecked baggage or make alternate arrangement for their transportation.
- Dangerous goods as specified in these general conditions;
- Fragile or perishable items;
- Money, jewellery, precious metals, silverware;
- Negotiable papers, share certificates, securities, or other valuable documents;
- Cameras, video cameras and related equipment;
- Commercial goods, samples or business documents;
- Electrical and electronic devices;
- Passports and other travel documents;
- Essential medicines.
If you carry items in contravention of these Conditions of Carriage, we will use all available defences
against any claim in respect of any damage, loss or destruction of those items.
- In all cases of alleged loss or damage, proof of actual loss or damage will be required in order to initiate investigation of any such claims.
- We will not be liable for any damage arising from compliance with any laws or Government regulations, order or requirements, or from your failure to comply with the same.
- We will have no liability for destruction, loss of or damage to your Checked Baggage if the damage resulted from the inherent defect or quality of Checked Baggage.
- We will have no limited or no liability for Damage to or loss of articles not permitted to be contained in Checked Baggage except as otherwise provided by the Montreal Convention and subject to applicable defences therein, including contributory negligence and wrongful acts or omissions by you.
- We shall not be liable for general wear and tear or for damage to protruding or moving parts, such as wheels and handles where we consider the parts are not of suitable quality or nature to withstand baggage handling during carriage by air.
- In the case of Checked or Unchecked Baggage if there has been contributory negligence on your part we may be exonerated wholly or partly from our liability in accordance with applicable law.
If part of journey includes code share flights or flights on other airlines, operating carriers’ baggage allowance applies. Be sure to label baggage inside and out, and with your name, address and contact number for your destination. Labels can be obtained from the Airlines, your local travel agent or at check-in. Mattresses will not be accepted for carriage as checked baggage (Accepted as Freight only).
14. INTERNATIONAL NOTICE – LIMITATION OF LIABILITY |
14.1 If your journey has a destination or stop in another country other than the one from which you depart, a treaty known as the Warsaw Convention may govern the liability of all airlines involved in your journey and may limit the amount of damages that can be recovered for your death or injury. However, many airlines have voluntarily agreed to waive those limits (in whole or in part).
14.2 Samoa Airways will not rely on the limitation in Article 22 (1) of the Warsaw Convention or the Warsaw Convention as amended at The Hague for any claim for recoverable compensatory damages arising under Article 17 of that Convention.
14.3 Samoa Airways will not rely on any defence under Article 20 (1) of the Convention for that part of any claim for recoverable compensatory damages arising under Article 17 of the Convention that does not exceed 100,000 Special Drawing Rights. Otherwise Samoa Airways will rely on all other defences under the Convention.
14.4 In addition, in cases of death or bodily injury, if required by law, Samoa Airways will make advance payments to the person entitled to compensation, if required, to meet immediate economic needs, in proportion to the hardship suffered.
14.5 Liability for loss, delay or damage to baggage is limited to about US$20 per kilo for checked baggage and US$400 per passenger for unchecked baggage.
14.6 There is no waiver of any rights or limitation of liability by any entity or carrier (including any carrier performing any part of the carriage shown on the ticket) other than Samoa Airways.
14.7 To the extent permitted by law all liability is excluded for:
- Any injury in the nature of depression, anxiety, depressive illness, functional overlay or psychiatric injuries or for distress, grief, or loss of enjoyment however caused;
- Any indirect or consequently loss or damage resulting from lost, damaged or delayed baggage, whether the carriage is international carriage or domestic carriage; and
- Normal wear and tear to baggage and for delay, damage or loss of fragile, delicate or perishable item, medicine, money, jewellery, precious metals, negotiable papers, securities, valuable items (including cameras, computers and electronic equipment), commercial goods or documents in checked baggage. Such items should be kept with you or in your cabin baggage under your care or sent by freight.
14.8 In respect to baggage liability is limited to the regulatory minimum for checked baggage and for cabin baggage. Damage must be sighted by an employee or representative of the Airline at the airport/airstrip. Delayed/lost baggage must be reported on arrival and a complaint in writing must be received within 14 days of when you should have received it.
14.9 For any direct or consequential losses or damages in relation to your baggage or articles that are not checked baggage, the Airline will not have any liability, subject to any rights you may have under Samoan law.
15.1 The Airline does not guarantee you any particular seat even if your reservation is confirmed. You must accept any seat allocated on the flight even if this involves a downgrade, or wait until the next flight on which a seat is available in the class of service paid for.
15.2 The Airline may refuse carriage of any passenger or passenger’s baggage without any liability on its part if due to the passenger’s physical state the passenger requires an additional seat unless the passenger agrees to pay for an additional seat at the applicable fare including all applicable fees and taxes, and other charges imposed by Governments, authorities or airport operators.
16. OVERBOOKING NOTICE/DENIED BOARDING |
16.1 There is a chance a seat will not be available on a flight even if your reservation is confirmed. This is due to the common practice in the airline industry of overbooking.
16.2 The Airline may refuse to refund a passenger for a ticket if the Airline’s failure to provide carriage in accordance with the contract of carriage is due to a government security directive.
17. GOVERNMENT & OTHER TAXES AND CHARGES |
The price of your ticket may include significant amounts of taxes, charges and fees imposed on air transport by governments, authorities and airport operators (in the fare e.g. Value Added Tax (VAT), Goods & Services Tax (GST), Departure Taxes, Noise levies, etc shown separately as a TAX/FEE/CHARGE). You may also be required to pay additional taxes, fees or charges not marked on your ticket.
You must pay your fare, including any taxes, fees and carriers charges in the currency of the country in which the Ticket is issued, unless we or our Authorised Agent permit or require you to use another currency at or before the time you pay (for example, because of the non-convertibility of the local currency). We may decide, and reserve our right, to accept payment in another currency.
Personal and baggage insurance is recommended. Details may be obtained from the Airline, or your travel agent.
The Airline, government or airport officers may require you to submit to clothing and body searches, require you to submit your baggage to searches or inspections and search or inspect your baggage with or without you.
20. RIGHT TO REFUSE CARRIAGE |
The Airline reserves the right to refuse carriage to any person who is unable to provide positive identification, does not possess valid travel documents or seeks to travel in violation of applicable law, tariffs or the General Conditions of Carriage, or is otherwise in breach of these Terms and Conditions, or is under the influence of drugs or alcohol, or it is necessary for the safety or comfort of other passengers or for the protection of property.
Smoking is not permitted on any Samoa Airways aircraft.
21.1 E-Cigarettes
The use of e-cigarettes is not permitted on board an aircraft. E-cigarettes and related devices must be carried as carry-on baggage exclusively in the cabin of the aircraft. E-cigarettes must not be carried as checked baggage.
For safety reasons, the following types of Dangerous Goods must not be carried in your baggage. These goods fall into the categories shown below. Brief cases and attaché cases incorporating Dangerous Goods such as lithium batteries or pyrotechnic devices are totally forbidden. Firearms and dangerous weapons are not permitted in the cabin.
